this is probably the closest they thought they could come to changing gun laws. there will be other amendments but in terms of a real prize for those looking to expand gun restrictions this was it and it didn't happen. >> how much of this was because of principled opposition to the amendment and how much an issue of risk/reward. in other words there was very little potential reward because it was probably never going to pass the house of representatives even if it was going to be voted on in the house. for some senators it might not even have been worth the risk of voting for it since it wouldn't have become law. >> reporter: a great question. it is hard to know how many senators decided not to vote for it for that reason. what tends to happen is as you get close to the magic number of 60 all of a sudden you can potentially get a whole bunch of other senators because the senators who are voting for it realize that, you know what, i might as well get on the side of a winning issue here. to your point that is exactly what did not happen here. you had gabby giffords

it so happens the background checks would not affect law-abiding gun owners. i believe in the second amendment. i think there is a right to bear arms and i don't think liberals are right when they say it only applies to malicious, and i was saying that before the heller amendment. on the other hand, this bill only affects people who are felons, who are adjudicated mentally ill, who are spousal abusers. if you're a law-abiding gun owner this isn't going to interfere with your rights but some of these gun organizations, the nra in particular, they can't win on the merits of the arguments so they scare people and that's what they've done here. having said that, if you represent one of these rural states they think if you vouch for this it is going to end up taking away your gun. >> okay. i want to turn to immigration reform because it is obviously why we booked the two of you, a big part of the immigration bill you and the other members of the gang of eight unveiled yesterday is about border security. some people are very skeptical that this actually would beef u
